What Types of Vehicles Are Covered in Kentucky?
Kentucky Lemon Law applies to:
- New vehicles under the original manufacturer’s warranty
- Passenger cars, trucks, SUVs, motorcycles, and vans
- Issues must be reported within 4 year.
- Leased vehicles that are still under warranty
Excludes: Used vehicles, commercial vehicles, or issues caused by misuse or accidents.
How Do I Qualify for Kentucky Lemon Law?
To qualify for Kentucky Lemon Law, the defect must:
- Arise within the first 12,000 miles or 12 months of delivery, whichever comes first, and be reported to the manufacturer in writing (Ky. Rev. Stat. Ann. § 367.842(1)).
- Survive a reasonable number of repair attempts. Kentucky presumes that standard is met when the same defect has been repaired 4 or more times, or the vehicle has been out of service 30 or more cumulative calendar days — both within that same 12-month/12,000-mile window (§ 367.842(3)).
- Kentucky’s lemon law does not cover motor homes, motorcycles, mopeds, or farm equipment.
- A lawsuit must be filed within 2 years of the original delivery date (§ 367.842(8)).
