What Vehicles Are Covered by Montana Lemon Law?

Montana Lemon Law applies to: New vehicles purchased or leased in Montana. Cars, trucks, SUVs, motorcycles, vans, and some recreational vehicles still under the manufacturer’s warranty. Not covered: used vehicles without warranty, commercial vehicles, or defects caused by abuse or accidents.

Am I Eligible Under Montana Lemon Law?

To qualify for Montana Lemon Law, the defect must:

  • Be reported during the “warranty period” — 2 years or 18,000 miles from original delivery, whichever is earlier (Mont. Code Ann. § 61-4-501(7)).
  • Survive a reasonable number of repair attempts. Montana presumes that standard is met when the same defect has been repaired 4 or more times, or the vehicle has been out of service 30 or more business days — both within the warranty period after notification (§ 61-4-504).
  • Written notice to the manufacturer is required before the warranty enforceable period runs out (§ 61-4-502).

Montana lemon law eligibility for used vehicles?

Montana Lemon Law does NOT cover used vehicles sold as used. However, certified pre-owned vehicles may qualify if still under the manufacturer’s original new vehicle warranty and meet the requirements of being less than 2 years from original delivery or under 18,000 miles (whichever is earlier). The law only covers new motor vehicles purchased, titled, or leased in Montana for personal, family, or household use.

What are the Montana lemon law filing deadlines and time limits?

Claims must be filed with BBB AUTO LINE within 1 year after the earlier of: (1) 2 years from the vehicle’s original delivery date, or (2) 18,000 miles of operation. Defects must be reported in writing to the manufacturer during the warranty period (2 years/18,000 miles). This period can be extended up to one additional year if a defect is reported in writing during the warranty period but not resolved.

Montana lemon law what counts as a repair attempt?

A reasonable number of repair attempts is presumed if, within the 2-year/18,000-mile warranty period: (1) the same nonconformity has been subject to repair 4 or more times and still exists, OR (2) the vehicle is out of service for repairs for 30 or more cumulative business days. The defect must substantially impair use, market value, or safety, and cannot be caused by abuse, neglect, or unauthorized modifications.

Manufacturers must provide either a full refund (purchase price + taxes, fees, collateral charges, and incidental damages minus reasonable use allowance) OR a replacement vehicle of the same model, style, and value (no use allowance deduction for replacements). Montana lemon law coverage details for motorhomes and trucks?

Montana lemon law covers the nonresidential/mechanical portion of motorhomes (chassis, engine, drivetrain) but excludes residential components (appliances, fixtures, furnishings, accessories). Trucks under 15,000 pounds GVWR are covered; trucks with 15,000+ pounds GVWR are excluded. The law covers passenger motor vehicles, motorcycles, and the driving portions of motorhomes purchased/leased in Montana within 2 years/18,000 miles for personal use.
