Your Rights Under Maryland Lemon Law

If your vehicle has a defect that affects its safety, value, or use, and it cannot be repaired after a reasonable number of attempts, Maryland Lemon Law guarantees your right to compensation, including:

  • Replacement: A new vehicle of the same make and model.
  • Repurchase: A full refund, including taxes and fees, minus a mileage deduction.
  • Cash Settlement: Compensation for the defect’s impact, with potential civil penalties up to three times the original amount.

Additionally, Maryland Lemon Law requires manufacturers to cover attorney fees, allowing you to pursue your claim without financial strain.

What Vehicles Are Covered by Maryland Lemon Law?

Maryland Lemon Law covers:

  • New and certified pre-owned vehicles under the manufacturer’s warranty.
  • Used vehicles with a remaining factory warranty.
  • Vehicles like cars, trucks, motorcycles, SUVs, RVs, and certain business vehicles (under 10,000 lbs).

Exclusions may apply for minor defects or issues caused by unauthorized alterations or misuse.

How to Qualify for Maryland Lemon Law?

To qualify for Maryland Lemon Law, the defect must:

  • Substantially impair the vehicle’s use and market value, and be reported during the manufacturer’s warranty period — Maryland ties eligibility to the full warranty term itself, with no separate 1-year or mileage cutoff (Md. Code Ann., Com. Law § 14-1502(b)).
  • Survive a reasonable number of repair attempts. Maryland presumes that standard is met when the same defect has been repaired 4 or more times, or the vehicle has been out of service 30 or more cumulative days — both within the warranty period. A brake or steering failure needs only 1 repair attempt (§ 14-1502(d)).
  • If a refund is due, your use allowance is capped at 15% of the purchase price, not a mileage-fraction formula.
  • A lawsuit must be filed within 3 years of the original delivery date (§ 14-1502(k)).

Types of Defects Covered by Maryland Lemon Law

Maryland Lemon Law protects consumers from defects that interfere with the vehicle’s operation or safety, including:

  • Engine failure
  • Braking system failure
  • Electrical malfunctions
  • Faulty airbag systems
  • Transmission issues
  • Steering and suspension defects

These defects must persist despite reasonable repair attempts and be covered under the manufacturer’s warranty

Lemon Law for Used Cars in Maryland

Maryland Lemon Law applies to used vehicles under the following conditions:

  • The defect must still be covered by the original manufacturer’s warranty.
  • It must significantly affect the vehicle’s safety, value, or use.
  • The defect must remain unresolved after reasonable repair attempts.

If your used vehicle qualifies, we can help you pursue compensation.

FAQs

FAQ Icon
How do I start a Maryland lemon law claim?

Document all repair attempts and write a certified letter to the manufacturer describing the defect, repair history (include VIN, make, model, year, purchase date, and copies of all repair orders). Maryland requires the manufacturer receive written notice and have 30 days to repair before you can demand replacement/refund. File a complaint with the Maryland Attorney General’s Consumer Protection Division simultaneously for mediation assistance.

What documents Maryland attorneys request for evaluation?

Bring your purchase/lease agreement, manufacturer’s warranty, complete repair orders/invoices from every repair attempt (arranged chronologically), certified mail receipts proving manufacturer notification, vehicle registration, out-of-service calendar documenting cumulative days unavailable, and all correspondence with dealer/manufacturer. Include VIN, exact problem descriptions, dates of each repair attempt, and any expert inspection reports if available.

How long do Maryland lemon law cases typically take?

Most Maryland lemon law cases resolve within 6-12 months. The timeline includes: manufacturer response (30 days after certified notice), Consumer Protection Division mediation (varies by complexity), optional arbitration (30-90 days for hearing and decision), and if necessary, court litigation (6-24+ months). Many cases settle during mediation or arbitration without going to court.

What remedies does Maryland lemon law provide vehicle repurchase or replacement?

Maryland provides your choice of replacement (comparable vehicle acceptable to you with no use deduction) OR full repurchase (full purchase price + license/registration fees, minus reasonable use allowance not exceeding 15% of purchase price and damage beyond normal wear). For leased vehicles: refund of all lease payments, repair costs, fees, minus reasonable use allowance. Excise taxes are refunded/credited separately through MD Motor Vehicle Administration.

Do Maryland lemon law attorneys work on contingency fees only or other arrangements exist?

Maryland lemon law attorneys typically work on manufacturer-pays basis (not traditional contingency) – if you win, the manufacturer pays your attorney’s fees and costs, meaning you pay nothing out-of-pocket. Some attorneys also offer contingency arrangements (percentage of recovery) or hourly/flat fee options. Most offer free initial consultations to evaluate your case. Always discuss fee structure upfront before proceeding.
