Florida’s Lemon Law, also known as the Motor Vehicle Warranty Enforcement Act, protects consumers who purchase or lease new vehicles that continue to have serious defects.

If your vehicle meets the criteria, the manufacturer is legally required to offer a repurchase, replacement, or compensation — and may also be required to pay for your legal representation.

Your Rights Under Florida Lemon Law

Florida’s lemon law, ensures that consumers who purchase or lease vehicles with defects are protected. If the manufacturer or dealer cannot fix the defect after a reasonable number of attempts, you may be entitled to compensation.

Options for Resolution Include:

  • Replacement: A comparable vehicle of the same make and model.
  • Repurchase: A full refund, including taxes and fees, minus a mileage offset.
  • Cash Settlement: Compensation for the decreased value or damages, with possible civil penalties up to triple the original amount.

Legal fees are often recoverable from the manufacturer — not you.

What Vehicles Are Covered?

Florida lemon law applies to:

  • New and certified pre-owned vehicles under the manufacturer’s warranty.
  • Used vehicles sold with remaining factory warranties.
  • Cars, trucks, motorcycles, SUVs, RVs, and certain business vehicles (weighing less than 10,000 lbs with five or fewer vehicles owned by the business).

Not Covered: Vehicles used primarily for business, off-road vehicles, RVs, and most used vehicles sold “as-is” without a warranty.

How to Qualify for a Florida Lemon Law Claim

To qualify for Florida Lemon Law, the defect must:

  • Be a nonconformity that substantially impairs the vehicle’s use, value, or safety.
  • Arise during the Lemon Law rights period — the 24 months following original delivery (Fla. Stat. § 681.102).
  • Remain unresolved after a reasonable number of repair attempts. Florida presumes that standard is met if the same nonconformity was subject to repair at least three times plus a final attempt, or the vehicle was out of service for a cumulative 30 or more days (§ 681.104).
  • A claim must be filed within 60 days after the Lemon Law rights period expires (§ 681.109).

Types of Defects Covered by Florida's Lemon Law

Florida’s lemon law covers significant defects that interfere with the vehicle’s operation or safety. Examples include:

  • Transmission or shifting problems
  • Repeated engine stalling or overheating
  • Brake or suspension failure
  • Persistent electrical or sensor issues
  • Air conditioning or cooling system failure
  • Power steering or safety system malfunctions
  • Dashboard warning lights that won’t reset
  • And more…

These defects must persist after a reasonable number of repair attempts and be covered by the manufacturer’s warranty.

FAQs

FAQ Icon
How do I check if my vehicle qualifies under Florida Lemon Law?

Your vehicle qualifies if it’s a new or demonstrator vehicle (purchased/leased in Florida), has a defect substantially impairing use/value/safety, reported within 24 months from delivery (Lemon Law Rights Period), and meets: 3+ repair attempts for same defect PLUS written notice to manufacturer for final repair OR 30+ calendar days out of service (15+ days triggers notice requirement).

What documents should I bring to a Florida lemon law attorney?

Purchase/lease agreement, manufacturer’s written warranty/owner’s manual, all repair orders (showing dates, mileage, problems reported, work completed, out-of-service days), written notification to manufacturer (certified/registered mail receipt), correspondence with manufacturer/dealer, proof of original delivery date (within 24 months), receipts for all expenses (purchase-related charges, incidental costs like towing/rental).

How long does Florida lemon law arbitration usually take?

Manufacturer-certified program (if applicable): Must decide within 40 days. Florida New Motor Vehicle Arbitration Board: File within 60 days after Lemon Law Rights Period OR 30 days after certified program decision. Total timeline from filing to resolution: typically 2-4 months for state Board arbitration. Many cases settle during or after arbitration without court proceedings.

What remedies can a Florida lemon law attorney pursue for me?

Replacement: Identical/reasonably equivalent vehicle (MSRP ≤105% of original) + collateral/incidental charges, minus usage offset. Refund: Full purchase price (including trade-in allowance) + collateral charges (taxes, fees, dealer items) + incidental charges (towing, rental) minus usage offset [(Miles ÷ 120,000) × Purchase Price]. Consumer chooses remedy; manufacturer has 40 days to comply. Courts may award attorney fees, litigation costs, enhanced damages ($25/day if appeal denied).

How are attorney fees handled in Florida lemon law cases?

Most Florida lemon law attorneys work on contingency basis (no upfront costs, fees only if you win). Florida law allows courts to award reasonable attorney fees and litigation costs to prevailing consumers, paid separately by the manufacturer. Under federal Magnuson-Moss Warranty Act, manufacturer pays your attorney fees if you win, making representation effectively free to consumers. Typical hourly rates: $400-$600 (paid by manufacturer, not you).
