New Hampshire's lemon law protects consumers who buy or lease vehicles with significant defects that are not resolved under the manufacturer’s warranty.

If the manufacturer cannot fix the defect, they must replace, repurchase, or provide cash compensation, potentially including civil penalties up to three times the original amount.

Your Rights Under New Hampshire Lemon Law

If you’ve made repeated trips to the dealership and your vehicle still isn’t fixed, New Hampshire Lemon Law may give you the right to:

  • Repurchase: Get a full refund including taxes, fees, and financing costs
  • Replacement: Receive a new vehicle of similar value and features
  • Settlement: Get compensated for inconvenience and loss of value
  • Legal Fees: Have your attorney’s fees paid by the manufacturer

You have a right to safe, reliable transportation — and legal protection if you didn’t get what you paid for.

What Vehicles Are Covered?

New Hampshire Lemon Law applies to:

  • New vehicles bought or leased in New Hampshire for personal, household, or family use.
  • Used vehicles purchased from a licensed dealership with less than 100,000 miles.
  • Cars, SUVs, motorcycles, and light-duty trucks under warranty.
  • Defects reported within 18 months or 18,000 miles.
  • Used vehicles with issues occurring within 90 days or 4,000 miles of purchase (whichever comes first).

Not Covered: Vehicles used primarily for commercial purposes, those over 100,000 miles (used), or those with problems caused by abuse.

How to Qualify for a New Hampshire Lemon Law Claim

To qualify for New Hampshire Lemon Law, the defect must:

  • Be reported during the express warranty term — New Hampshire has no separate 1-year or mileage fallback.
  • Survive a reasonable number of repair attempts. New Hampshire presumes that standard is met when the same defect has been repaired 3 or more times, or the vehicle has been out of service 30 or more business days — both within the warranty term (N.H. Rev. Stat. Ann. § 357-D:3, VII).
  • A proceeding must be commenced within 1 year after the later of the warranty term expiring or the manufacturer’s final repair attempt (§ 357-D:11, I).

Types of Defects Covered by New Hampshire's Lemon Law

These common issues may meet the requirements of New Hampshire Lemon Law if they remain unresolved:

  • Engine failure or stalling
  • Transmission slipping or hesitation
  • Steering or suspension issues
  • Brake system defects
  • Persistent dashboard warning lights
  • Repeated electrical or HVAC malfunctions
  • Safety system failures (airbags, seat belts, etc.)
  • And more…

If your dealership hasn’t fixed the problem after multiple attempts, your vehicle may be considered a lemon.

Lemon Law for Used Cars in New Hampshire

Unlike most states, New Hampshire’s Lemon Law does cover certain used cars. You may qualify if: The vehicle had under 100,000 miles at the time of purchase. It was purchased from a licensed dealer, not a private party. The issue reduces the car’s safety or reliability. FAQs

FAQ Icon
How do I check if my vehicle qualifies under New Hampshire lemon law?

Your vehicle qualifies if it has a defect substantially impairing use, value, or safety that remains unfixed after 3+ repair attempts for the same problem OR has been out of service for 30+ business days during the express warranty term. Each repair attempt must be documented with a written repair order from the manufacturer, agent, or authorized dealer.

What evidence should I collect for a New Hampshire lemon law claim?

You need all written repair orders/examination records from each repair attempt, purchase or lease agreement, manufacturer’s express warranty documents, vehicle registration(s), retail installment/finance contract, Summary of Repair History form, proof of written notification to the manufacturer using their standardized form, and receipts for incidental expenses like towing and rental cars.

How long do I have to file a lemon law claim in New Hampshire?

You must commence proceedings within 1 year following the later of either: (1) the expiration of the express warranty term, or (2) the manufacturer’s final repair attempt of the nonconformity. Defects must be reported during the warranty period to qualify.

What remedies can an NH lemon law attorney obtain for me?

You can receive either a comparable replacement vehicle from the same manufacturer (with all options/accessories, adjusted for model year differences) OR a full refund including purchase price, license/registration fees, finance charges, and incidental/consequential damages, minus a reasonable use allowance. The manufacturer must also pay reasonable attorney’s fees and costs.

Do leased vehicles qualify under New Hampshire lemon law?

Yes, leased vehicles are fully covered under New Hampshire lemon law with the same protections as purchased vehicles. Lessees (other than for sublease) have identical rights to repurchase or replacement, with refund amounts divided between the lessee and lessor according to their respective interests.
